Announcement of rulemaking

The Colorado State Public Health Laboratory at the Colorado Department of Public Health and Environment (CDPHE) has initiated the rulemaking process for Senate Bill 23-290: Natural Medicine Regulation And Legalization. 

On September 18, 2024, the Board of Health approved CDPHE’s request for rulemaking for 5 CCR 1005-7 Natural Medicine Testing Facility Certification and Testing. The proposed rule set establishes testing standards for natural medicine and natural medicine products, as well as the certification of laboratories to perform this testing. 

CDPHE is seeking feedback on the draft rules for implementing this law in regards to product testing and the testing facility inspection and certification process. While the law has specific requirements that must be met, rulemaking is important as it determines how the laws will be carried out.

CDPHE wants to hear from a wide range of people who have an interest or expertise in the issues the law addresses. These include, but are not limited to, testing lab representatives and natural medicine cultivators and manufacturers.

If you have suggestions, concerns, or questions about these proposed rules and wish to provide your feedback, you may:

  1. Stakeholders can provide feedback and sign up to receive updates by using this online feedback form. CDPHE must receive your comments by September 30, 2024, at 5 p.m. In order to be considered, feedback must be limited to the proposed rules. 
  2. Email the Board of Health directly at cdphe.bohrequests@state.co.us. Feedback provided this way will be added to the official rulemaking record. It is recommended that comments and testimony on rulemakings be submitted to the Board in writing by 5 p.m. the Thursday prior to the Board’s meeting. Refer to the Board of Health webpage for more information about the hearings.
